Acknowledgment of risk

I, the undersigned participant, hereby acknowledge and agree to the following:

1. Voluntary Participation

   I am voluntarily participating in Cable Carnival Wakeboarding Competition ("the Event"). I understand that wakeboarding is an inherently dangerous activity that carries significant risks, including, but not limited to, serious bodily injury, paralysis, or death.

2. Assumption of Risk

   I acknowledge that the risks associated with wakeboarding include, but are not limited to:

   • Collisions with other participants, objects, or structures.

   • Falls resulting in contact with the water, wakeboard, or other surfaces.

   • Equipment malfunction or failure.

   • Adverse weather conditions.

   • Fatigue, exhaustion, or other physical conditions.

   I understand that these risks may be caused by my own actions or inactions, the actions or inactions of others, the condition of the equipment, or the conditions of the venue. I voluntarily assume full responsibility for any and all risks, injuries, or damages, known or unknown, which may arise as a result of my participation in the Event.

3. Fitness to Participate

   I affirm that I am physically fit and have no known medical conditions that would prevent my participation in the Event. I acknowledge that it is my responsibility to consult with a physician before participating in any physically demanding activities.

Waiver of Liability

1. Release of Claims

   In consideration of being permitted to participate in the Event, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, and discharge the organizers of the Cable Carnival Wakeboarding Competition, including The Peacock Brothers, its officers, employees, volunteers, sponsors, and any other affiliated entities (collectively, "the Released Parties") from any and all claims, demands, liabilities, or causes of action, including those arising from the negligence of the Released Parties, that may arise out of or relate to my participation in the Event.

2. Covenant Not to Sue

   I agree that I will not make any claim or take any legal action against the Released Parties for any injuries, damages, or losses sustained as a result of my participation in the Event. I understand and agree that this waiver of liability includes any claims based on the negligence, actions, or inactions of the Released Parties.

3. Indemnification

   I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of or related to my participation in the Event.

   
   

Additional Terms

1. Governing Law

   This Acknowledgment of Risk and Waiver of Liability shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

2. Severability

   If any provision of this waiver is found to be unenforceable or invalid, that provision shall be severed from this waiver and the remaining provisions shall remain in full force and effect.

3. Entire Agreement

   This document constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior or contemporaneous oral or written agreements.
